Variance Request

A resident may apply for a variance for the proposed construction if the construction or remodel project does not comply with the CC&Rs or the Architectural Design Standards because of an unusual physical condition of the property. 

Please refer to Pima County Code § 18.93.030. Variances as well as the Architectural Design Standards for details on valid reasons for requesting a variance.

If plans have already been submitted for review by the Architectural Review Committee, the following information must be submitted to complete the variance application process:

  1. Name of property owner and appropriate contact information

  2. Address of property

  3. Lot number

  4. Letter justifying an exception to the CC&Rs (not based on the needs of the owner but on a physical condition of the property)

  5. Those requirements enumerated in the Architectural Design Standards relating to the variance process.

If plans have not been received by the Architectural Review Committee for review, please submit the following:

  1. Name of property owner and appropriate contact information

  2. Address of property

  3. Lot number

  4. Letter justifying an exception to the CC&Rs (not based on the needs of the owner but on a physical condition of the property)

  5. Requirements included in the Design Standards

  6. Landscape and/or Revegetation Plan as more particularly described in the Landscaping Standards

Upon receipt of a variance request, the Board will consider the request in accordance with the relevant provisions of the Design Standards.

Please note: Approval of a variance request is not an architectural approval and it is still subject to municipal zoning approval.
